4:36 p.m. — First block of Byron Ellinor Drive
Battery. Following an argument about mail, a 60-year-old man struck his tenant with a cooler multiple times, leading to a small car accident and aggressive stand-off all within the rental property.
The incident began when the Deltona man asked the other tenant at the property if he would hold on to some mail for him. The victim then advised the other tenant that it was illegal, upsetting the man. Police report the victim and the defendant then got into a verbal argument, which escalated when the victim said an expletive to the defendant, at which point he began to hit the victim with the cooler.
After the initial incident, the defendant got into his RV and drove it from the backyard to the south side of the home where he struck the victim's car. A witness said this appeared intentional.
The victim then yelled at the defendant to stop and got in between his vehicle and the RV. Police reported that the defendant got out of his vehicle to move some yard debris before getting back in and hitting the victim with his RV, striking the victim's right side.
When police made contact with the defendant, he admitted he hit the victim with a cooler but emphasized that it was a small, empty, Igloo brand cooler.
12:48 a.m. — 700 block of W. Granada Blvd.
DUI. A 42-year-old woman was arrested on DUI charges after refusing a breathalyzer test by officers, despite already having chucked her heels and completed the series of sobriety exercises.
Police stopped the woman after noticing her erratic driving on W. Granada Boulevard. Officers made contact with her, asking her if she knew the reason why she was stopped. The woman replied: "I know, I overcorrected."
When asked how much she'd had to drink, the woman told police "enough." She told police she had four margaritas that night and that she was "trying to get sober." The woman later changed her statement to "trying to get my sister sober."
Police commented on her shoes, noticing she had high heels on. The woman then said: "I can't do any of this on a normal day, can I take them off?" Police asked her what she meant, and she replied she wasn't "that intelligent."
During the Walk and Turn sobriety exercise, the woman said she was unable to perform it correctly because of her weight and an issue with her hip. She was also unable to complete the One Leg Stand exercise, saying she couldn't do that on a "good day" and that her physical trainer was working with her on that.
Police reported that the woman's mood changed from happy and laughing to sad and crying over the course of the traffic stop. She was transferred to the Volusia County Branch Jail and was given a waiver review for first time DUI offenders.
