Routine traffic stop leads to drug and firearm arrest

An officer stopped Perrill A. Perkins for his window tint being darker than the legal limit.

An Ormond Beach police officer pulled a driver over for illegally dark window tint, but ended up making an arrest on drug and weapons charges.

Perrill A. Perkins, 31, of Daytona Beach, was arrested and charged with possession of marijuana with the intent to sell, possession of a stolen firearm, possession of a firearm and ammunition by a felon and possession of drug paraphernalia.

Perkins was pulled over at 88 S. Atlantic Ave. Feb. 18, when an officer stopped him to check his car's window tint, which allowed 17% visibility, darker than the 28% Florida Statute allows, according to reports.

While running his information, the officer discovered Perkins had a warrant out of New Jersey for failure to appear on narcotics charges.

Perkins, according to the report, was also “on Florida Inmate Release Status’ for Possession of Marijuana Over 20 Grams.” That made the officer wonder whether Perkins had narcotics in the car.

The officer began writing Perkins a warning for the window tint and called the department's K-9 unit for further assistance.

The drug-detecting dog alerted its handler to the presence of narcotics, and when the officers told Perkins they were going to make a probable-cause search, he said, according to the report, "I can't let you do that," explaining that he had a firearm in the vehicle.

Officers found a Smith & Wesson .38 caliber handgun, with a round in the chamber, inside the closed center console.

The firearm, according to the report, had been stolen Dec. 21, during a vehicle burglary in Daytona Beach.

Officers also found three plastic containers with small "dime baggies" of marijuana, totaling 172 grams, along with a small digital scale.

According to the report, Perkins was convicted of Homicide and Carrying a Concealed Weapon in 2003, and convicted of Possessing Marijuana with Intent to Distribute in 2007, both out of Volusia County.

He was sentenced to state prison in both cases, according to the report.

Perkins, according to the report, told a Daytona Beach detective he purchased the firearm for $100, approximately a month ago.
