Palm Coast man arrested for touching himself in bed next to 7-year-old, Flagler Sheriff's Office says

Alan Avellan Jr., 38, was arrested last October after allegedly showing children pornographic videos on a home TV. Avellan is now facing multiple additional sex-crime charges.

A man who was arrested last fall for showing pornographic images to children has been charged with multiple other sex crimes against a 14-year-old and a 7-year-old girl.

The Flagler County Sheriff's Office originally arrested Alan Avellan Jr., 38, after he had “airplayed” or “casted” pornographic videos onto his home's television while several children were present, on two separate occasions, a FCSO news release said. On Feb. 5, the FCSO Major Case Unit received a complaint against Avellan on two separate incidents that occurred last July.

A 7-year-old girl and her 14-year-old sister were visiting a friend at Avellan's home when the incidents occurred. The 7-year-old said she wanted to watch a movie but her sister and friend were playing video games on the living room TV, so the friend told her to go to Avellan's room to watch a movie, according to Avellan's arrest report.

She did, and Avellan walked into the room and laid down on the bed next to her. That is when the 7-year-old said Avellan began to "rub his private area" before showing her his genitals and ejaculating on the bed, the report said.

That is when the 14-year-old told deputies that, on a separate occasion, when she was sleeping over at the home, Avellan walked in on her as she was getting out  of the shower, the arrest report said, even though she had locked the door. She said she had also seen his phone under the door when it was closed.

Deputies obtained a search warrant of Avellan's phone and found the video of a girl exiting a shower. The girl was confirmed to be the 14-year-old by herself, her mother and a witness from Avellan's home.

FCSO deputies rearrested Avellan on March 13 at the Flagler Beach Tax Collector's office, a FCSO press release said. He has been charged with two counts of video voyeurism on a victim under 16, two counts of unlawful use of a two-way communication device and one count of lewd and lascivious exhibition.

He is being held on $250,000 bond.

Sheriff Rick Staly asked parents who know their children have been around Avellan to talk to their kids. If their child may be another victim, the parents should call the FCSO immediately, he said.

“These crimes are even more horrific and despicable than the original arrest," Staly said. "While we’re glad he’s back in the Green Roof Inn, we look forward to seeing him go to prison for a very long time so he can’t victimize any more of our community’s children."
